DISCLOSURES OF INTEREST

(Members Code of Conduct - Part 4A of the Constitution)

 

To receive disclosures of interests from members and co-opted members on matters to be considered at the meeting. The disclosure must include the nature of the interest.

 

An interest must also be disclosed in the meeting when it becomes apparent to the member during the meeting.

 

Notes:

 

(1)       Members may remain in the meeting and take part fully in discussion and voting unless the interest is a disclosable pecuniary interest or an interest which the Member feels would call into question their compliance with the wider principles set out in the Code of Conduct.  Disclosable pecuniary interests relate to the Member concerned or their spouse/partner.

 

(2)       Members in arrears of Council Tax by more than two months must not vote in decisions on, or which might affect, budget calculations, and must disclose at the meeting that this restriction applies to them.  A failure to comply with these requirements is a criminal offence under section 106 of the Local Government Finance Act 1992.

Minutes:

(i)         In the interest of transparency Councillor Barker and Councillor Whiteley disclosed that they had been consulted as Ward Councillors on the Burley Traffic Regulator Order contained in Document “C” but were prepared to listen to the opposing views and consider all relevant information with an open mind.

 

(ii)        In the interest of transparency Councillor Warnes disclosed that one of his fellow Ward Councillors (Councillor H Hussain) owned a property on Alexandra Road, Shipley which backed onto Back Kirkgate, Shipley which was the location referred to in the petition contained in Document “D”.

OBJECTIONS TO PROPOSED TRAFFIC REGULATION ORDER FOR PARKING RESTRICTIONS WITHIN BURLEY VILLAGE pdf icon PDF 2 MB

The Strategic Director of Regeneration will submit Document “C” which considers 37 objections received from local residents, businesses and road users to proposals to introduce parking restrictions in and around Burley village.

 

Recommended –

 

(1)       That the proposed Traffic Regulation Order to introduce parking restrictions in the Burley village area as shown on Drawing No. R/N/AS/101191/TRO-1A (attached as Appendix 1 to Document “C”) be approved, sealed and implemented as formally advertised subject to the following amendments:

 

(a)       The proposed double yellow lines on Main Street and Long

Meadow be omitted from the proposals.

 

(b)              That consideration be given to reducing some of the proposed double yellow lines on Far Mead Croft and that the proposals be discussed with elected Members for Wharfedale.

 

(2)       That the objectors be advised accordingly.

Minutes:

The Strategic Director of Regeneration submitted Document “C” which considered 37 objections received from local residents, businesses and road users to proposals to introduce parking restrictions in and around Burley village.

 

The Principal Engineer provided a summary of the report.

 

A Member who was also a Ward Councillor for the Wharfedale Ward stated that the double yellow lines proposed for William Fison Rise would have been more appropriate on the other side of the road due to access to the recreation ground.  In response, the Principal Engineer stated that, by law, this change would require the advertisement of another Traffic Regulation Order (TRO) as this had not been consulted on.  Officers were asked to consider this as part of any future TROs for the area.

 

An objector to the proposals addressed the Committee.  He stated that there would not be enough car parking spaces available near Far Mead Croft as a result of the proposals.  He believed the car parking problems had been created by the Council when it previously introduced parking restriction in the area.  There was already insufficient car parking space available to residents of 144 to 158 Main Street and people had started to park close to the junction.  He considered there was enough space to create two additional parking spaces on West Terrace where he resided.  The off-street public car park in the vicinity was often overflowing and there was nowhere for residents to park.  He circulated photographs of the landscaping on entrance to Far Mead Croft and spoke of its lack of maintenance by the Council which caused a road safety hazard and covered the road signage; he had taken to cutting it back himself so that the pavement was accessible for pedestrians.  He stated that many residents were unaware of the proposals.

 

The Chair asked the Shipley Area Co-ordinator, who was in attendance at the meeting, to consider whether arrangements could be made for the landscaped area on entrance to Far Mead Croft to be looked after by the community or whether it could be used for car parking.  A Member who was also a Ward Councillor for the area stated that Highways were reviewing the possibility of widening the entrance to Far Mead Croft.

 

In response to a Member’s questions, the objector stated that there were no restrictions on who could park in the car park near West Terrace and there were approximately 210 houses in the estate which included Far Mead Croft.

 

Members acknowledged that car parking in the village was problematic. 

 

The Principal Engineer circulated photographs of parked vehicles blocking access in the area, in support of implementing parking restrictions.

 

A supporter of the proposals addressed the Committee.  He believed the proposals were good for the village and the double yellow lines proposed for Southfield Road should be increased. PETITION REQUESTING THE INTRODUCTION OF A 'RESIDENTS ONLY PERMIT PARKING' SCHEME ON BACK KIRKGATE, SHIPLEY pdf icon PDF 3 MB

The Strategic Director of Regeneration will submit Document “A” which considers a petition requesting the introduction of a ‘Residents Only Permit Parking’ scheme on Back Kirkgate, Shipley. The letter which accompanied the petition also expresses concerns regarding lack of enforcement of the ‘Prohibition of Motor Vehicles (Except for Access Only)’ Order on Back Kirkgate, as well as speeding and vehicular obstruction of garages and driveways on Back Kirkgate.

 

Recommended –

 

(1)     That the Committee notes the petitioners’ concerns and recommends no further action regarding the request for a permit parking scheme at this moment in time. However, the petitioners' request be reconsidered should the Council’s permit parking policy criteria be revised.

 

(2)     That West Yorkshire Police be formally advised of the petitioners’ concerns regarding enforcement of the existing ‘Prohibition of Driving (Except for Access)’ Order on Back Kirkgate, Shipley.

 

(3)     That the petitioners be advised that obstruction of private driveways and/or garages is something West Yorkshire Police and/or the Council's Parking Services Unit could potentially investigate with a view to carrying out enforcement.

 

(4)     That the lead petitioner be informed accordingly.

The Shipley Area Co-ordinator confirmed that Council Wardens were able to use enforcement powers in relation to obstructions to properties. 

 

A Member referred to Appendix 2 of Document “A” and stated that no distinction had been made between properties that did and did not have access to off street parking.  He stated that he was aware of one property on Alexandra Road that had a solid fence at the back and in practical terms the resident could not access off-street parking.  He added that Back Kirkgate was ‘access only’ and that he was aware of vehicles accessing it illegally and parking all day.  He supported enforcement action to tackle the problem.

 

Resolved –

The Strategic Director of Regeneration will submit Document “B” which considers a petition requesting the introduction of traffic calming within Cullingworth Village. The petition goes on to request that consideration be given to the provision of safety cameras or other measures to address local traffic concerns.

 

Recommended –

 

(1)     On the basis of the speed survey results contained within this report, B6144 Haworth Road be included on the list of traffic management scheme candidates to be considered annually by this Committee for possible inclusion within its future programme of locally determined works; and

 

(2)     On the basis of the volumetric ‘through traffic’ survey results contained within this report, Hallowes Park Road, Sunningdale Crescent, Westhill Avenue and Greenside Lane be included within  this Committee’s list of scheme candidates considered annually for possible inclusion within its future programme of locally determined works; and

 

(3)     In the event of the mini-roundabout at the junction of Manywells Brow and B6144 Cullingworth Road not being included within the list of proposed casualty reduction schemes to form part of this Committee’s 2016/17 Safer Roads Scheme Programme, that the mini-roundabout be included on the list of scheme candidates to be considered annually by this Committee for possible inclusion within its future programme of locally determined works.

 

(4)     That the lead petitioner be informed accordingly.

The Strategic Director of Regeneration submitted Document “B” which considered a petition requesting the introduction of traffic calming within Cullingworth Village. The petition also requested that consideration be given to the provision of safety cameras or other measures to address local traffic concerns.

 

The Principal Engineer provided a summary of the report.

 

A Ward Councillor addressed the Committee and thanked the Principal Engineer for the review he had carried out.  He informed the Committee that a proposal by Parkside School on Parkside Terrace to increase its intake had been approved by Executive yesterday.  At that meeting a request had been made that discussions take place with the Highways department regarding access to the school.  He went on to inform the Committee of a planning application to build a new Co-op in the village to replace the existing one but in a different location, which was subject to planning permission.  He raised concerns in relation to the number of injury accidents at the mini-roundabout and stated that its markings had worn away.  He considered improvements to the signage and lineage at the mini roundabout were a priority for the village as well as tackling speeding on Haworth Road.  He stated there was a need to guard against continued pressure for vehicles to get through the village rather than making the village safer.

 

The Principal Engineer assured Members that he would contact Highways Development Control in relation to traffic concerns on Parkside Terrace given the increased intake agreed for Parkside School.

 

Members were informed that there were plans for Highways Maintenance to carry out remedial works at the mini roundabout.

 

Resolved –

(1)       That Rhodes Street, Back Rhodes Street West, Baker Street and Back Baker Street West be included on the list of traffic management scheme candidates to be considered annually by this Committee for possible inclusion within its future programme of works.

 

(2)     That the lead petitioner be informed accordingly.

The Strategic Director of Regeneration submitted Document “D” which considered a petition requesting the introduction of a ‘Residents Only Permit Parking’ scheme on Rhodes Street, Back Rhodes Street West, Baker Street and Back Baker Street West, Saltaire.

 

The Principal Engineer provided a summary of the report.

 

It was recognised that Shipley College and businesses in the area generated an exceptional amount of traffic which was becoming increasingly difficult for residents in the area.

 

The Principal Engineer informed Members that the on-street parking survey which had been carried out on 9 November 2015 had identified residents’ vehicles by registration numbers but the reasons for the parking of non-resident vehicles was not known.

 

A Member who was also a Ward Councillor for the area thanked the Principal Engineer for the work he had carried out and for his liaison work with residents.  He suggested that, if there were no parking restrictions on Back Baker Street, it be added to the list of traffic management scheme candidates to be considered in the Committee’s future programme of works.

 

Resolved –

 

(1)       That Rhodes Street, Back Rhodes Street West, Baker Street and Back Baker Street West be included on the list of traffic management scheme candidates to be considered annually by this Committee for possible inclusion within its future programme of works.

 

(2)     That the Principal Engineer be requested to investigate whether there are any parking restrictions on Back Baker Street, Saltaire and if there are none that it be added to (1) above.

 

(3)     That the lead petitioner be informed accordingly.

The Strategic Director of Regeneration will submit Document “E” which considers a request for an Informal Disabled Persons Parking Place (DPPP) where the applicant does not satisfy all the criteria laid down in the Council’s approved policy, but still wishes to pursue the provision of a facility.

 

Recommended –

 

That the request for an Informal DPPP at Grange Road, Burley in Wharfedale, be processed, and if there are no objections, a space be installed.  If there are objections, the request be referred back to this Committee.

The Strategic Director of Regeneration submitted Document “E” which considered a request for an Informal Disabled Persons Parking Place (DPPP) where the applicant did not satisfy all the criteria laid down in the Council’s approved policy, but still wished to pursue the provision of a facility.

 

The Principal Engineer provided a summary of the report.

 

A Member queried whether the DPPP was required and whether there were any access problems at the location which appeared to be a cul-de-sac on Appendix 2 of the report.  Clarification was provided that the report was asking for approval to undertake initial investigations to consider whether it was viable to implement the DPPP.

 

Resolved –

 

That the request for an Informal DPPP at Grange Road, Burley in Wharfedale, be processed, and if there are no objections, a space be installed.  If there are objections, the request be referred back to this Committee.
