In light of the evidence presented to the Panel by the Council’s Environmental Health Department which makes reference to noise nuisance and the serving of an Abatement Notice, the Panel is not convinced that the prevention of public nuisance objective would be fully addressed and therefore authorises service of a Counter Notice preventing the Temporary Event.

 

Reason – This decision supports the Licensing objective of Prevention of Public Nuisance.

(2)  That Paragraph 12.1 (Appendix 1 to Document “AF”) be clarified further to ensure that relevant reporting is undertaken if an extension of contract means the new value of the contract is above a relevant reporting threshold had it not been previously reported.

 

(3)  That the Social Value and Inclusive Growth Policy be referred to the Corporate Overview and Scrutiny Committee for consideration when the policy is reviewed.

 

(4)  That the terminology relating to Appropriate Officer in Appendix 2 to Document “AF” remain consistent throughout the report.

That having considered all valid representations made by the parties to the hearing; valid written representations received during the statutory period, the published statement of licensing policy and relevant statutory guidance; the panel grants the application, in part, and allows the variation of the licence for the sale of alcohol on and off the premises on Sunday 11.00 to 12.00 noon.  However, in light of the compelling evidence of persistent nuisance related to the premises the application for variation of the licence for the sale of alcohol on and off the premises and the extension of the opening hours on Friday and Saturday is refused.

 

Reason – it is considered that the above refusal is necessary to
minimise noise disturbance; to deter and ameliorate anti-social behaviour and protect children from harm – prevention of public nuisance and protection of children from harm objectives of the Licensing Act 2003.

Reason – It is considered that the refusal is appropriate and proportionate to ensure promotion ofthe Prevention of Crime and Disorder objective and the Protection of Children from Harm objective of the Licensing Act 2003.
