LAND AT ASHLANDS ROAD, ILKLEY

The Committee is asked to consider Document “S” which presents a reserved matters application requesting consideration of access, appearance, landscaping, layout and scale of a residential development of 14 dwellings (pursuant to outline approval reference 16/04629/MAO) – land at Ashlands Road. Ilkley – 18/03853/MAR.

 

Recommended –

 

That the reserved matters application be approved, for the reasons and subject to the conditions set out in appendix 1 to Document “S”.

The Committee was asked to consider (Document “S”)which presented a reserved matters application requesting consideration of access, appearance, landscaping, layout and scale of a residential development of 14 dwellings (pursuant to outline approval reference 16/04629/MAO) – land at Ashlands Road. Ilkley – 18/03853/MAR.

 

The Assistant Director provided an overview of the proposed development, showing photographs of the site, plans and drawings and summarising the representations that had been received.

 

The Assistant Director stated that a number of additional conditions were being proposed regarding drainage and additional terms such as landscaping and boundary treatment plan.

 

Objectors were present at the meeting and stated that the site of the proposed development regularly flooded and as such was unsuitable for development and that the proposed drainage would not adequately deal with the problem.  In addition the lack of parking was already an issue in the area and 14 additional houses plus a vets surgery would only increase the amount of traffic using the area, and they urged that the application be refused.

 

In response to the concerns raised by the objectors, the Assistant Director explained that the highways issues had already been dealt with at the outline stage and that a number of highway upgrades were being proposed by way of condition.  In relation to drainage, the proposed conditions would adequately deal with any surface water run off from the site and no adverse concerns had been raised by the Lead Local Flood Authority.  In addition odour tests had also been carried out by Yorkshire Water and the application was considered acceptable.

 

During the discussion a Member raised concerns about the suitability of the proposed garages to house a vehicle, and it was stated that the garages were in addition to the two car parking spaces allocated for each dwelling.  Members were adamant that the proposed garages should be not be converted into habitable rooms and a condition should therefore be imposed to that effect, and it was therefore:

 

Resolved

 

That the reserved matters application be approved, for the reasons and subject to the conditions set out in appendix 1 to Document “S” and also subject to the following additional conditions:

Reason: For the avoidance of doubt as to the terms under which this planning permission has been granted.

 

(ii)        Swale Details

 

Notwithstanding the details contained in the supporting information, the flood mitigation works shall not commence until full details of the proposed swales including their maintenance regime, have been submitted to and approved by the local planning authority. The development shall thereafter only proceed in strict accordance with the approved details.

 

Reason: To ensure the provision of satisfactory drainage infrastructure in the interests of flood prevention and to accord with Policy EN7 of the Core Strategy Development Plan Document

 

 

(iii)       Permitted Development Rights Removed: Garage Conversions

 

Notwithstanding the provisions of The Town and Country Planning (General Permitted Development) (England) Order 2015 (or any subsequent equivalent legislation) the integral garages within the dwellings hereby permitted shall remain available for the purposes of garaging and no subsequent alterations to convert these garages to primary residential accommodation addition shall be carried out without the express written permission of the Local Planning Authority.

 

Reason:  In the interests of amenity and highway safety and to accord with Policies TR2, DS4 and DS5 of the Core Strategy Development Plan Document.
