60.

DISCLOSURES OF INTEREST

(Members Code of Conduct - Part 4A of the Constitution)

 

To receive disclosures of interests from Members and co-opted members on matters to be considered at the meeting. The disclosure must include the nature of the interest.

 

An interest must also be disclosed in the meeting when it becomes apparent to the Member during the meeting.

 

Notes:

 

(1)       Members may remain in the meeting and take part fully in discussion and voting unless the interest is a disclosable pecuniary interest or an interest which the Member feels would call into question their compliance with the wider principles set out in the Code of Conduct.  Disclosable pecuniary interests relate to the Member concerned or their spouse/partner.

 

(2)       Members in arrears of Council Tax by more than two months must not vote in decisions on, or which might affect, budget calculations, and must disclose at the meeting that this restriction applies to them.  A failure to comply with these requirements is a criminal offence under section 106 of the Local Government Finance Act 1992. 

 

(3)       Members are also welcome to disclose interests which are not disclosable pecuniary interests but which they consider should be made in the interest of clarity.

 

(4)       Officers must disclose interests in accordance with Council Standing Order 44.

INSPECTION OF REPORTS AND BACKGROUND PAPERS

(Access to Information Procedure Rules – Part 3B of the Constitution)

 

Reports and background papers for agenda items may be inspected by contacting the person shown after each agenda item.  Certain reports and background papers may be restricted. 

 

Any request to remove the restriction on a report or background paper should be made to the relevant Strategic or Assistant Director whose name is shown on the front page of the report. 

 

If that request is refused, there is a right of appeal to this meeting.

The Strategic Director, Place will present a report (Document “BC”) which asks the Committee to consider the grant of a Service Level Agreement passing the responsibility for the maintenance and management of land held within the Royd House Trust known as Wilsden Park to Wilsden Parish Council.

 

Recommended –

 

That the Trustees of Royd House Trust approve the grant of a Service Level Agreement to Wilsden Parish Council transferring the responsibility for the management and maintenance of the recreation ground.

The Strategic Director, Corporate Resources will present a report (Document “BD”) which asks the Committee to consider the grant of a Service Level Agreement passing the responsibility for the management and maintenance of the recreation ground to Wilsden Parish Council.

 

Recommended –

 

That the Trustees of the Firth Lane Recreation Ground approve the grant of a Service Level Agreement to Wilsden Parish Council making them responsible for the management and maintenance of the recreation ground.

The Strategic Director, Corporate Resources presented a report (Document “BD”) which asked the Committee to consider the grant of a Service Level Agreement passing the responsibility for the management and maintenance of the recreation ground to Wilsden Parish Council.

 

Both the above matters were considered together in a joint presentation, and the Senior Surveyor Estates and Property explained that the reports were requesting the approval of a Service Level Agreement for both sites, which would allow the management and maintenance  responsibility of the two sites to be passed onto Wilsden Parish Council.  Wilsden Parish Council had requested this change and the Neighbourhood Service were happy for it to proceed.

 

It was also proposed that other sites would be included in the future, these however were not part of the charitable trust, and did not form part of these proposals.

 

The commuted sum would be £10k per annum to be paid to Wilsden Parish Council .  The Service Level agreement would not change the role of the Trustees and this was in no way related to the disposal of land , but merely to the maintenance and management issues affecting the two sites.  Any future status or disposal would require a different course of action. The details of the SLA were set out in the report.

The Chair of Wilsden Parish Council was present at the meeting and in welcoming the proposals stated that Wilsden Parish Council had proposed this course of action which would ensure better maintenance, in the context of concerns raised in relation to the park and recreation field, particularly for the maintenance of green spaces.  An asset transfer was also being looked, however it was acknowledged that  this would require a separate, more complicated legal process.

The Chair acknowledged the points made by the Parish Councillor and welcomed the commitment of the Parish Council, and it was therefore:

That the Trustees of the Firth Lane Recreation Ground approve the grant of a Service Level Agreement to Wilsden Parish Council making them responsible for the management and maintenance of the recreation ground.
