DISCLOSURES OF INTEREST

(Members Code of Conduct - Part 4A of the Constitution)

 

To receive disclosures of interests from members and co-opted members on matters to be considered at the meeting. The disclosure must include the nature of the interest.

 

An interest must also be disclosed in the meeting when it becomes apparent to the member during the meeting.

 

Notes:

 

(1)       Members may remain in the meeting and take part fully in discussion and voting unless the interest is a disclosable pecuniary interest or an interest which the Member feels would call into question their compliance with the wider principles set out in the Code of Conduct.  Disclosable pecuniary interests relate to the Member concerned or their spouse/partner.

 

(2)       Members in arrears of Council Tax by more than two months must not vote in decisions on, or which might affect, budget calculations, and must disclose at the meeting that this restriction applies to them.  A failure to comply with these requirements is a criminal offence under section 106 of the Local Government Finance Act 1992. 

 

(3)       Members are also welcome to disclose interests which are not disclosable pecuniary interests but which they consider should be made in the interest of clarity.

 

(4)       Officers must disclose interests in accordance with Council Standing Order 44.

The report from the Director, Place (Document”H”) addresses the four objections received in response to the formal advertisement of a permit parking scheme on Wrose View, Wrose, Shipley.

 

Recommended –

 

  1. That the objections be overruled and the proposed permit parking scheme be approved and implemented as formally advertised.

 

  1. That an appraisal be carried out regarding the number of parking permits issued to Wrose View residents and the extent that those permits are utilised, with a view to determining the scope for the issuing of special permits to non Wrose View residents

 

  1. That the objectors be advised accordingly.

The report of the Strategic Director of Place (Document “H”) dealt with four objections received in response to the formal advertising of a permit parking scheme on Wrose View, Wrose, Shipley.

 

As part of planning conditions attached to Planning Application 18/04869/FUL, and in the interests of road safety and traffic management, there was a requirement to promote a Traffic Regulation Order (TRO) regarding a proposed permit parking scheme on Wrose View, Wrose. The report seeks approval to promote the TRO and considered the four objections received in response to the advertising of that proposed legal Order.

 

Approval was granted to promote a Traffic Regulation Order involving a proposed Permit Holders Only parking scheme on Wrose View, Wrose -  this provision forming part of Planning Application 18/04869/FUL which involved a proposed extension to Low Ash Primary School, Wrose Road, to cater for an additional 210 pupils.

 

The development included an additional pedestrian access point from Wrose View into the school playground. This would likely entice parents to use Wrose View to park at school drop-off and collection times. Overspill parking from the new staff car park would also likely take place on Wrose View as a result of the proposed development. As such, a residents permit parking scheme was required on Wrose View to help ensure the planning proposal did not give rise to vehicular obstruction.

 

The Principal Engineer, Traffic and Highways North Principal Engineer presented the report and provided photographs to illustrate parking which took place on the grass verge on Wrose View.  He explained that the demand for permits would be assessed before offering any discretionary permits.

 

A member commented that a number of properties on Wrose View had driveways or garages and as there were facilities for off street parking he was of the opinion that there would be little need for permits.  In response the Principal Engineer noted that the policy would be adapted to local needs to take account of such thigs as school traffic locking driveways.

 

A member noted that there could be significant issues for a small number of properties on Wrose Road and asked whether they could be included.  The Principal Engineer responded that they wanted to avoid over subscription by none residents and that it was not appropriate to offer discretionary permits until demand had been assessed.  He confirmed that requests for permits from residents would be assessed prior to implementation and discretionary permits would be offered if demand allowed.

 

It was noted that the proposals were supported by ward members to maintain the current position if the rear aces to the school opened up.

PETITION - USE OF 'PARKING BUDDIES' ON THE HIGHWAY pdf icon PDF 85 KB

The report of the Strategic Director, Place (Document “I”) will be presented to the Committee to consider the petition for the use of ‘Parking Buddies’ on the highway. 

 

Wilsden Parish Council purchased, in good faith, a form of traffic management (Parking Buddies) on advice provided by the Highways Department.  Subsequently was discovered that the use of Parking Buddies is contrary to Highway statutes and are unable to be used in the way intended.

 

Recommended -

 

1.    That the Committee resolves to request that the Council reimburses the Town Council for the cost of the Parking buddies and an alternative use of this resource is found (Option 1);

 

2.    That the Committee requests that the Traffic and Highways North office and the Road Safety Team work closely with Wilsden Parish Council and Wilsden Primary School to alleviate safety concerns in the vicinity of the school and beyond.

The report of the Strategic Director, Place (Document “I”) was submitted to the Committee to consider the petition for use of ‘Parking Buddies’ on the highway.

 

‘Parking Buddies’ had been previously purchased following consultation with the Highways Department, Bradford City Council.  Subsequently, it was discovered that use of this type of resource on the highway constituted a breach of Highways statutes and could not be used in the way it had been intended.

 

 

The Highways Officer reiterated that the cost could be refunded and that the Highways team would work with the Parish Council and the school to address safety concerns.

 

Members were then given the opportunity to ask questions and make any comments, the details of which and the responses given are as below:

 

A Member asked where ‘Parking Buddies’ could be used and was advised by Officers that they were only permitted on private property.  They could also be attached to railings but could not be placed on the public footpath or highway.

 

A Member asked if these presented an obstruction on the highway, could they be strapped onto lampposts and not on the highway.  Officers advised that this possibility was being investigated and could be a ‘work-around’ and there was a sufficient budget to reimburse for the purchase if no solution was found.

 

A Member noted that the conflicting advice from the DfT was not helpful and similar resources had been used by Police and Fire Services in other areas.  The public would notice the removal of obstructions and not concentrating efforts to address bad parking and driving near to schools.

 

The Lead Petitioner attended the meeting and addressed the Committee and explained that use of this type of resource was allowed in other Local Authorities and provided details and images of deployed resources to demonstrate that there were situations similar to that in Wiilsden.  The school had already taken measures to address the problem including notices, signs and yellow lines.  A similar resource had been deployed elsewhere for 2 years and was deemed as effective.  For the short time that they had been permitted in Wilsden there was an improvement in parking habits which declined when the Parking Buddies were removed.

 

The evidence in the report and supporting documentation provided by the petitioner did appear to show some contradiction in guidance from DfT with no clear conclusion.

 

A discussion then took place between Members and the Highways Officer as these would be placed where parking was not permitted in any case.  They were in use elsewhere so why was it not ‘legal’ in Bradford.  The Highways Officer stated that he was of the view that they could not permit their use.  The legality and scheme of delegation to officers was also raised as Highways did not consider them to be legal.  Legal advice had already been sought by Highways and it was deemed to be the correct decision to prohibit their use.
