APPOINTMENT OF CHAIR

Minutes:

In the absence of the deputy chair it was resolved that Councillor Lal be appointed Chair for the purposes of this meeting.

(3)       Members in arrears of Council Tax by more than two months must not vote in decisions on, or which might affect, budget calculations, and must disclose at the meeting that this restriction applies to them.  A failure to comply with these requirements is a criminal offence under section 106 of the Local Government Finance Act 1992. 

 

(4)       Officers must disclose interests in accordance with Council Standing Order 44.

DELEGATION SCHEME FOR TRANSPORTATION AND HIGHWAYS DECISIONS 2023 pdf icon PDF 162 KB

The Strategic Director of Place will submit a report (Document “E”) which seeks the committee’s approval to replacing the Council’s current Transportation and Highways Scheme of Delegation (2017) with an up-to-date scheme for regulation of officer decision-making.

 

Recommended –

 

(1)       That the Regulatory and Appeals Committee approves the adoption   of the replacement Scheme of Delegation for Highways and       Transportation matters as set out in Appendix B to Document “E”    in substitution for the current Scheme of Delegation for Highways     and Transportation matters as set out in Appendix A to Document      “E” in so far as the powers listed in the revised Scheme of   Delegation are non- Executive functions.

(2)       That the revised Scheme of Delegation as set out in Appendix B to     Document “E” will become operative only if, and when, approved            by both Executive and Regulatory and Appeals Committee and the           provisions of the previous Scheme of Delegation as set out in             Appendix A to Document “E” will then be revoked.

(3)       That the revised Scheme of Delegation shall remain in force until such time as it may be substituted, modified, varied, or repealed by decisions of the Executive or Regulatory and Appeals Committee or such person or body inheriting the powers of the Executive or Regulatory and Appeals Committee.

The Strategic Director of Place submitted a report (Document “E”) which sought the committee’s approval to replacing the Council’s current Transportation and Highways Scheme of Delegation (2017) with an up-to-date scheme for regulation of officer decision-making. The Highways Services Manager provided a summary of the proposed changes, details of which were set out in Document “E.

 

During the discussion, a Member stated that he hoped that the new scheme still reflected the need for ward member input into decisions that affected their wards, stressing that ward members ultimately represented their constituents.  In response it was stated that ward member input was considered crucial and to this end it had been embedded into the scheme of delegation as appropriate.

 

In response to a question regarding authorisation, it was explained that the Scheme of Delegation had been amended to ensure that officers maintain documentary evidence in progressing of a scheme.  In response to a concern that this may detract from officers performing their duties, it was stressed that the documentary evidence could be completed on standardised forms and therefore record keeping should not prove too onerous.

 

Members welcomed the proposed changes to the Scheme of delegation as set out in Document “E”, stating that it was clearly set out and would provide clarity, and it was therefore:
