20.

DISCLOSURES OF INTEREST

(Members Code of Conduct – Part 4A of the Constitution)

 

To receive disclosures of interests from members and co-opted members on matters to be considered at the meeting. The disclosure must include the nature of the interest.

 

An interest must also be disclosed in the meeting when it becomes apparent to the member during the meeting.

 

Notes:

 

(1)       Members must consider their interests, and act according to the following:

Disclose the interest; remain in the meeting, participate and vote unless the matter affects the financial interest or well-being

 

 (a) to a greater extent than it affects the financial interests of a majority of inhabitants of the affected ward, and

 

(b) a reasonable member of the public knowing all the facts would believe that it would affect your view of the wider public interest; in which case speak on the item only if the public are also allowed to speak but otherwise not do not participate in the discussion or vote; and leave the meeting unless you have a dispensation.

 

(2)       Disclosable pecuniary interests relate to the Member concerned or their spouse/partner.

 

(3)       Members in arrears of Council Tax by more than two months must not vote in decisions on, or which might affect, budget calculations, and must disclose at the meeting that this restriction applies to them.  A failure to comply with these requirements is a criminal offence under section 106 of the Local Government Finance Act 1992. 

 

(4)       Officers must disclose interests in accordance with Council Standing Order 44.

21.

INSPECTION OF REPORTS AND BACKGROUND PAPERS

(Access to Information Procedure Rules – Part 3B of the Constitution)

 

Reports and background papers for agenda items may be inspected by contacting the person shown after each agenda item.  Certain reports and background papers may be restricted. 

 

Any request to remove the restriction on a report or background paper should be made to the relevant Strategic or Assistant Director whose name is shown on the front page of the report. 

 

If that request is refused, there is a right of appeal to this meeting.

22.

EXCLUSION OF THE PUBLIC

Recommended –

 

That the public be excluded from the meeting during consideration of the appendices relating to the Royd House Trust in Wilsden, to on the grounds that it is likely in view of the nature of the business to be transacted or the nature of the proceedings, that if they were present, exempt information within Paragraph 3  (Finance or Business Affairs) of Schedule 12A of the Local Government Act 1972 (as amended), would be disclosed and it is considered that, in all the circumstances, the public interest in excluding public access to the relevant part of the proceedings outweighs the interest in publication of the report.

23.

ROYD HOUSE TRUST IN WILSDEN pdf icon PDF 105 KB

The Strategic Director Place will submit a report (Document “J”) which request the agreement of Regulatory and Appeals Committee, as Trustees of the Royd House Trust in Wilsden, to grant three awards recommended and pre-approved by the Evaluation Group.

 

Recommended –

 

That the Trustees, agree the three applications set out in the Appendices to Document “J” and that all future agreements and approvals for grant awards be delegated solely to the Strategic Director of Place or their successor.

Minutes:

The Strategic Director Place submitted a report (Document “J”) which requested the agreement of Regulatory and Appeals Committee, as Trustees of the Royd House Trust in Wilsden, to grant three awards recommended and pre-approved by the Evaluation Group.

 

It was explained that a number of organisations had applied for funding, the details of which were set out in the appendices.  It was stressed that given the amounts requested, if Members wished, future applications could be delegated to the Strategic Director for determination.

During the discussion Members were advised that the evaluation group consisting of three ward Councillors, a parish council representative and an officer made recommendations on the applications, and therefore the decision making process was a robust one.

A number of Members expressed their reservations at the proposed delegation to the Strategic Director, adding that the Trustees should ultimately be making decisions on applications.

However, majority of the Members were satisfied that the current process was working well, however if the Trustees were minded to delegate the decision to the Strategic Director, it should be on the proviso that if he/she was minded to refuse the application, then the application should be referred back to the Trustees for determination, and was therefore:

Resolved –

 

That the three applications set out in the Not for Publication Appendices to Document “J” be approved and that all future agreements and approvals for grant awards be delegated to the Strategic Director of Place or their successor.  If the Strategic Director is minded to refuse the application(s), then the decision be referred back to the Trustees for determination.

 

Note: Under Standing Order 42.2, Councillors Brown and Sullivan requested that their vote against be recorded.

24.

Further to the meeting of the Trustees held on 27 October and 24 November 2022, the Trustees are requested to consider and approve the attached application forms which have been drafted by the Ward Officer Bingley & Baildon Wards.

Further to the meeting of the Trustees held on 27 October and 24 November 2022, the Trustees were requested to consider and approve the application forms which had been drafted by the Ward Officer Bingley & Baildon Wards.

 

In terms of the proposed application form, Members suggested a number of minor changes, such as reference to the Council’s Equal Opportunities in dealing with applications and not to set a ceiling on the amount that could be applied for on the general application.

A number of other suggestions were made and the application process and it was therefore:

Resolved –

 

(1)       That the maximum funding amount for the discretionary element         be set at £5000, for any applications over this amount, matched      funding is encouraged and the applicant/organisation be asked to      contact the Ward Officer for Bingley and Baildon Wards to       discuss the application further. 

 

(2)       That there be two application rounds for the discretionary element      and that applicants be advised that repeat applications will not be           encouraged.
