DISCLOSURES OF INTEREST pdf icon PDF 74 KB

(Members Code of Conduct - Part 4A of the Constitution)

 

To receive disclosures of interests from members and co-opted members on matters to be considered at the meeting. The disclosure must include the nature of the interest.

 

An interest must also be disclosed in the meeting when it becomes apparent to the member during the meeting.

 

Notes:

 

(1)       In relation to Agenda Item 7A to approve the following recommendations contained in the report of the Monitoring Officer (Document “D”) to grant a dispensation to all Members who have certain Disclosable Pecuniary Interests listed in Appendix A to the report, as defined in the Relevant Authorities (Disclosable Pecuniary Interests) Regulations 2012, in the decision to approve the budget and to set the level of Council Tax and Business Rates for 2021/22 and 2022/23 during the Budget Council meetings on 18 February 2021 and 17 February 2022.

That Council:

 

(1)       Grants a dispensation to the Members of the Authority who have requested one, to enable them to participate in full in the decision to approve the budgets for 2021/22 and 2022/23 and to set the Council Tax and Business Rates for 2021/22 and 2022/23.

(2)       Approves the dispensation for a period of two years until 18 February 2022.

(3)       Notes Members’ personal interests and the Monitoring Officer’s advice that personal interests that may give rise to a perception of a conflict of interest shall not prevent Members from speaking and voting at the Budget meetings.

 

(2)       Members may remain in the meeting and take part fully in discussion and voting unless the interest is a disclosable pecuniary interest or an interest which the Member feels would call into question their compliance with the wider principles set out in the Code of Conduct.  Disclosable pecuniary interests relate to the Member concerned or their spouse/partner.

 

(3)       Members in arrears of Council Tax by more than two months must not vote in decisions on, or which might affect, budget calculations, and must disclose at the meeting that this restriction applies to them.  A failure to comply with these requirements is a criminal offence under section 106 of the Local Government Finance Act 1992. 

 

(4)       Members are also welcome to disclose interests which are not disclosable pecuniary interests but which they consider should be made in the interest of clarity.

 

(5)       Officers must disclose interests in accordance with Council Standing Order 44.

The report of the Monitoring Officer (Document “D”) considered the granting of dispensations to all Members who had certain Disclosable Pecuniary Interests as defined in the Relevant Authorities (Disclosable Pecuniary Interests) Regulations 2012 for approving the budget and setting the Council Tax and Business Rates. Members had also disclosed interests which were not disclosable pecuniary interests but which they considered should be made in the interests of clarity.

 

The lists attached as appendices A and B to the report had been updated with further notifications by Members on their declarations. It was,

 

Resolved –

 

That Council:

WRITTEN ANNOUNCEMENTS FROM THE LORD MAYOR (Standing Order 4)

DEATH OF COUNCILLOR, AND FORMER LORD MAYOR, ABID HUSSAIN

 

The Lord Mayor reported the shock and sadness in learning of the death of Councillor, and former Lord Mayor, Abid Hussain on 24 December 2020. He was a great advocate for Keighley and its people, and he worked closely with his ward colleagues to promote and enhance the town and its prospects. 

 

Abid became a Labour Councillor for the Keighley Central Ward in 2010 and sat on a number of Council committees, and was currently Chair of the Education Appeals Panel, and Deputy Chair of the Keighley and Shipley Area Planning Panel and Keighley Area Committee. As Lord Mayor in 2017/2018, supported by his wife Shahnaz as Lady Mayoress, it proved to be a busy, varied and highly rewarding Civic year.

 

The Lord Mayor had written to Councillor Abid Hussain’s widow, Shahnaz, and family, to express sorrow at his passing.

 

DEATH OF COUNCILLOR MICHAEL ELLIS

 

It was also the very sad duty of the Lord Mayor to formally report to Council the death of Councillor Mike Ellis, which occurred on 12 January 2021. 

 

Councillor Ellis was Conservative Group Chief Whip and a Bingley Rural Councillor.  He was first elected in 1991 and represented constituents in the Worth Valley ward until 1995.  From 2006 he served the people of the Bingley Rural ward Mike served on numerous Council committees, covering nearly every aspect of the local authority's business, as well as contributing to many outside bodies.

 

The Lord Mayor had written to his widow, Kath and their family, to convey deep sympathies in their loss.

 

 

DEATH OF FORMER LORD MAYOR, TONY CAIRNS, OBE

 

With great sorrow the Lord Mayor reported the death, on 14 February 2021, of former Lord Mayor Tony Cairns, OBE, at the age of 89. Tony was elected as a Labour Councillor for the Tong Ward and served his constituents from 1984 until 2010. Between 1994 and 1997 he was the Leader of the Council and in 1997/98 he, and his late wife Jean, served as Lord Mayor and Lady Mayoress. Tony served on many Council committees and was at one-time Chair of Social Services and Policy and Resources. He also served as Chief Whip and Chair of the Labour Group. On outside bodies, Cllr Cairns served as Deputy Chair on the board of Leeds Bradford International Airport and also sat on Bradford University Council.

 

The Lord Mayor had written to Tony’s son and family to offer condolences, on behalf of the district, in their loss.

 

The Lord Mayor recognised that the loss of two serving Councillors, and a distinguished former Councillor and Lord Mayor, would be felt profoundly by Members and throughout the district and placed on record this Council’s gratitude for their many years of eminent service.

 

Members paid tribute and observed a minute’s silence.

 

DEATH OF CAPTAIN SIR TOM MOORE

The report of the Director of Finance provides details of the Council’s Revenue Estimates for 2021/22 (Executive Document “DL”). This report may require updating following the meeting of the Executive on 16 February 2021.

The report of the Director of Finance (Executive Document “DI”) sets out the S151 Officer’s assessment of the proposed budget for the financial year 2021/22, the adequacy of the forecast level of reserves and associated risks. The assessment of the Executive’s recommendations to Council on the budget may require updating following the meeting of the Executive on 16 February 2021.

The report of the Director of Finance (Executive Document “DE”) presented to the Executive on 2 February 2021 provides an update on national announcements and local decisions. It also identifies issues and uncertainties which could still have a bearing on the final size of the budget for 2021/22 and future financial years.

 

In accordance with Section 149 of the Equality Act 2010, Council needs to have regard to the information contained in Appendix B to Executive Document “DE” and the Annex to Appendix B together with the equality assessments when considering the Executive’s recommendations on the budget proposals for 2021/22.

PAY POLICY STATEMENTS 2020/21 AND 2021/22 pdf icon PDF 137 KB

In accordance with the Localism Act 2011 Local Authorities are required to produce and publish a Pay Policy Statement for each financial year.  The report of the Director of Human Resources (Document “E”) contains the Pay Policy Statement which must be approved by full Council before publication.

 

Recommended –

 

That the Pay Policy Statement for the financial year 2020/21 as set out at Appendix 1 to Document “E” and the Pay Policy Statement for the financial year 2021/22 as set out at Appendix 2 to Document “E”, be approved.
