DISCLOSURES OF INTEREST

(Members Code of Conduct – Part 4A of the Constitution)

 

To receive disclosures of interests from members and co-opted members on matters to be considered at the meeting. The disclosure must include the nature of the interest.

 

An interest must also be disclosed in the meeting when it becomes apparent to the member during the meeting.

(b) a reasonable member of the public knowing all the facts would believe that it would affect your view of the wider public interest; in which case speak on the item only if the public are also allowed to speak but otherwise not do not participate in the discussion or vote; and leave the meeting unless you have a dispensation.

 

(2)      Disclosable pecuniary interests relate to the Member concerned or their spouse/partner.

 

(3)      Members in arrears of Council Tax by more than two months must not vote in decisions on, or which might affect, budget calculations, and must disclose at the meeting that this restriction applies to them.  A failure to comply with these requirements is a criminal offence under section 106 of the Local Government Finance Act 1992. 

 

(4)      Officers must disclose interests in accordance with Council Standing Order 44.

Reports and background papers for agenda items may be inspected by contacting the person shown after each agenda item.  Certain reports and background papers may be restricted. 

 

Any request to remove the restriction on a report or background paper should be made to the relevant Strategic Director or Assistant Director whose name is shown on the front page of the report. 

 

If that request is refused, there is a right of appeal to this meeting.

APPLICATION FOR A PREMISES LICENCE FOR KASHMIRI AROMA HAWORTH, 51 MILL HEY, HAWORTH, KEIGHLEY, BD22 8NA pdf icon PDF 108 KB

The Assistant Director of Waste, Fleet, Environmental Health and Licensing Services will submit a report (Document “AA”) outlining an application for the grant of a premises licence for the sale of alcohol for consumption on and off the premises and the provision of regulated entertainment indoors.

Minutes:

The report of the Assistant Director, Waste, Fleet, Environmental Health and Licensing Services (Document “AA”) outlined an application for the grant of a premises licence for the sale of alcohol for consumption on and off the premises and the provision of regulated entertainment indoors. The Licensing Officer summarised the report and highlighted the proposed hours of licensable activity, as well as the relevant representation that had been received, set out in Appendix 2 to Document “AA”. Attention was given to the steps proposed by the applicant to address the licensing objectives.

 

At the invitation of the Chair the applicant, acting on behalf of Kashmiri Aroma Haworth Ltd, made an opening statement in which the representation that had been received was addressed. The Panel were told that until now alcohol had not been sold from the premises, no complaints about noise or anti-social behaviour had been received, and that alcohol would be sold with food. The Panel were also informed that the premises were open to negotiation regarding opening times and the hours of licensable activity.

 

A Member asked about the plans of the premises contained within the report, particularly whether outdoor seating was a possibility. Members were informed that there was no intention to have outdoor seating.

 

In relation to the steps proposed to address the licensing objectives the applicant was asked to clarify what was inferred by ‘not using external areas after a certain time’. It was clarified that this meant no activity in external areas after the restaurant had closed, and it was added that outdoor seating was not a consideration due to constraints of space.

 

A Member asked about waste disposal and raised concerns about the potential for noise disturbance to residents from the emptying of bottle bins. The Panel were told that waste bins would be located at the back of the premises.

 

The Legal Officer asked if a previous application had been submitted and was informed that applications had been submitted for other premises and no issues had been raised.

 

Resolved –

 

That having considered all valid representations made by the parties to the hearing; valid written representations received during the statutory period, the published statement of licensing policy and relevant statutory guidance; the Panel grants the application, as applied for, subject to the following condition:

 

That the disposal of waste bottles into externally located receptacles shall not take place between the hours of 2300 and 0900 on any day.

 

Reason – it is considered that the above condition is necessary to minimise noise disturbance to nearby residents – Prevention of Public Nuisance Objective.
