DISCLOSURES OF INTEREST

(Members Code of Conduct – Part 4A of the Constitution)

 

To receive disclosures of interests from members and co-opted members on matters to be considered at the meeting. The disclosure must include the nature of the interest.

 

An interest must also be disclosed in the meeting when it becomes apparent to the member during the meeting.

(3)       Members in arrears of Council Tax by more than two months must not vote in decisions on, or which might affect, budget calculations, and must disclose at the meeting that this restriction applies to them.  A failure to comply with these requirements is a criminal offence under section 106 of the Local Government Finance Act 1992. 

 

(4)       Officers must disclose interests in accordance with Council Standing Order 44.

The Assistant Director Waste, Fleet and Transport Services will present a report (Document “G”) which outlines an application for the grant of a premises licence for the sale of alcohol for consumption on and off the premises and the provision of regulated entertainment indoors and outdoors in respect of Wishbone Tap, 60 Low Street, Keighley, BD21 3PT.

The Licensing Officer provided a summary of the report (Document “G”) which outlined the application for the grant of a premises licence for the sale of alcohol for consumption on and off the premises and the provision of regulated entertainment indoors and outdoors in respect of Wishbone Tap, 60 Low Street, Keighley, BD21 3PT.

The Licensing Officer informed Panel Members of the representations received from a local business, which raised concerns of noise nuisance from regulated entertainment which could cause disturbance to residents in the living accommodation and also to the health care business which operated 24 hours a day. Safety concerns for female staff were also raised with reference to the crime rate in the area.

 

The Applicant provided details of the application to Panel Members advising Members that Wishbone Tap was a local market brewery in Keighley and had been operating for 7 years with no issues with the Police. Wishbone Tap specialised in making brewery in-house which was not sold in any supermarkets, this has appealed to consumers looking for unique tastes in beer.

The Applicant further advised Members of the Panel of the proposed operating hours and assured that consumers would be off the premises by 22:30. Any early opening hours were to be used for local community groups serving tea and coffee only.

The Applicant informed that there were no restrictions on the street for emergency vehicles and the rear yard would be fenced off so as not to cause any nuisance to local residents. Other safety measures would be put in place i.e. good lighting at the rear of the building, refuse to serve intoxicated customers, no under 18’s would be allowed after 18:00 and to be accompanied by a parent/responsible adult after 18:00, CCTV cameras would be in all public areas of the premises and all staff would be trained to enforce the Challenge 21/25 scheme.

 

Panel Members requested to know if the residents living accommodation was in operation.

In response the Applicant advised that there were no residents currently living at the accommodation, however people had been seen carrying out works at the building.

 

Panel Members were keen to understand how outdoor live music entertainment would affect local residents.

In response Members were advised that the opening hours would not affect local residents much, entertainment would be stopped by 22:30.

 

Panel Members were keen to understand the concept behind drinks for the modern drinker.

In response the Applicant explained that the beer environment had changed over the years and modern beers had a wide range of flavours and tastes, this was an interesting and more modern form of drinking. The aim was to provide Keighley something new and interesting, something customers would not need to travel far to enjoy.

The Licensing Officer presented the report (Document “H”) which invited Members to consider a personal licence holder, who had been convicted of a relevant offence (Section 132A of the Licensing Act 2003).

 

 

Resolved –

 

That having considered the evidence contained in the report of the Assistant Director, Waste, Fleet and Transport Services (Document H), the published statement of licensing policy and relevant guidance, evidence from all representatives and to support Part 4 of the licensing policy objectives:

 

·         the Prevention of Crime and Disorder objective of the Licensing Act.

·         the Prevention of Public Nuisance objective of the Licensing Act.

·         the Public Safety objective of the Licensing Act.

·         the Protection of Children from Harm objective of the Licensing Act.

REVOKE the Personal Licence in respect of Mr Abdullah.
