DISCLOSURES OF INTEREST

(Members Code of Conduct - Part 4A of the Constitution)

 

To receive disclosures of interests from members and co-opted members on matters to be considered at the meeting. The disclosure must include the nature of the interest.

 

An interest must also be disclosed in the meeting when it becomes apparent to the member during the meeting.

 

Notes:

 

(1)       Members may remain in the meeting and take part fully in discussion and voting unless the interest is a disclosable pecuniary interest or an interest which the Member feels would call into question their compliance with the wider principles set out in the Code of Conduct.  Disclosable pecuniary interests relate to the Member concerned or their spouse/partner.

 

(2)       Members in arrears of Council Tax by more than two months must not vote in decisions on, or which might affect, budget calculations, and must disclose at the meeting that this restriction applies to them.  A failure to comply with these requirements is a criminal offence under section 106 of the Local Government Finance Act 1992. 

 

(3)       Members are also welcome to disclose interests which are not disclosable pecuniary interests but which they consider should be made in the interest of clarity.

 

(4)       Officers must disclose interests in accordance with Council Standing Order 44.

INSPECTION OF REPORTS AND BACKGROUND PAPERS

(Access to Information Procedure Rules – Part 3B of the Constitution)

 

Reports and background papers for agenda items may be inspected by contacting the person shown after each agenda item.  Certain reports and background papers may be restricted. 

 

Any request to remove the restriction on a report or background paper should be made to the relevant Strategic Director or Assistant Director whose name is shown on the front page of the report. 

 

If that request is refused, there is a right of appeal to this meeting.

The Interim Assistant Director Waste, Fleet and Transport Services will present a report (Document “S”) which outlines an application for a Premises Licence for the provision of late night refreshment to take place indoors in respect of Dessert Guys, 248 Oakworth Road, Keighley, BD21 1RB

 

Members are invited to consider the information and documents referred to in (Document “S”) and, after hearing interested parties, determine the related application.

The Interim Assistant Director, Waste, Fleet and Transport Services presented a report (Document “S”) outlining an application for a Premises Licence for the provision of late night refreshments in respect of Desserts Guys, 248 Oakworth Road, Keighley, BD21 1RB.

 

The Licensing Officer advised the Panel that the application was for a premises license for the provision of late night refreshments to take place indoors from Monday to Sunday 23:00 hours to 01:00 hours.   Representation had been received from Environmental Health, who had raised concerns in relation to noise and disturbance to nearby residents.

 

The Premises License Holder was present at the meeting and addressed the Panel the reasons to why he wishes to extend the opening hours beyond the current 23:00 hours. He explained to the Panel that there was a high demand from customer and most of the request were during after 23:00 hours. Extending the opening hours would improve the business and gain additional sales, and equally it would give opportunities to offer better customer services. He further explained that there had been no objections from residents and by extending the opening hours would not cause disruption to nearby residents. Nonetheless, all measures would be put in place to mitigate any issues.

 

In response to the Panel’s questions, the Premises License Holder clarified that as well as customers visiting the premises they also provided a delivery service. Furthermore, the extra three hours of operation until 04:00 hours would be required during the Christmas and Eid festivals.

 

The Environmental Health Officer was present at the meeting and raised objections to the application. It was felt that allowing the business to operate beyond the current closing time would cause issues with noise from patrons and delivery drivers. The Panel was informed that one objection had been received raising concerns to litter, noise and parking issues.

 

In response to the Panel’s question, the Environmental Health Officer stated that similar businesses nearby operated to similar hours and should be in line with similar businesses in Keighley. 

 

Resolved:

 

(1)  That having considered the evidence contained in the report of the Interim Assistant Director, Waste, Fleet and Transport Services (Document ‘S’); all valid representations made by the parties to the hearing; valid written representations received during the statutory period; the published statement of licensing policy and relevant statutory guidance, the Panel grants the application for the provision of late night refreshments to take place indoors:-

 

That the permitted hours of late nigh refreshments shall be restricted to;

 

(a)  Monday – Sunday 23:00 hours – 01:00 hours;

 

(b)  23:00 hours – 04:00 hours during the five days Eid Festival; and

 

(c)  23:00 hours – 04:00 hours during Christmas Eve, Christmas Day and Boxing Day.

 

(2)  That the following conditions be impose:-

 

(a)  That the Premises License Holder shall ensure that the external areas around the perimeter of the premises are kept clear of litter and refuse; and
