DISCLOSURES OF INTEREST

(Members Code of Conduct - Part 4A of the Constitution)

 

To receive disclosures of interests from members and co-opted members on matters to be considered at the meeting. The disclosure must include the nature of the interest.

 

An interest must also be disclosed in the meeting when it becomes apparent to the member during the meeting.

 

Notes:

 

(1)       Members may remain in the meeting and take part fully in discussion and voting unless the interest is a disclosable pecuniary interest or an interest which the Member feels would call into question their compliance with the wider principles set out in the Code of Conduct.  Disclosable pecuniary interests relate to the Member concerned or their spouse/partner.

 

(2)       Members in arrears of Council Tax by more than two months must not vote in decisions on, or which might affect, budget calculations, and must disclose at the meeting that this restriction applies to them.  A failure to comply with these requirements is a criminal offence under section 106 of the Local Government Finance Act 1992. 

 

(3)       Members are also welcome to disclose interests which are not disclosable pecuniary interests but which they consider should be made in the interest of clarity.

 

(4)       Officers must disclose interests in accordance with Council Standing Order 44.

(Access to Information Procedure Rules – Part 3B of the Constitution)

 

Reports and background papers for agenda items may be inspected by contacting the person shown after each agenda item.  Certain reports and background papers may be restricted. 

 

Any request to remove the restriction on a report or background paper should be made to the relevant Strategic Director or Assistant Director whose name is shown on the front page of the report. 

 

If that request is refused, there is a right of appeal to this meeting.

The report of the Assistant Director, Waste, Fleet and Transport Services

(Document “F”) invites Members to consider interim steps under s53B Licensing Act 2003, pending a Summary Review application from West Yorkshire Police, of the Premises Licence for Bijou Cocktail Bar, 10 Chapel Lane, Bingley, which authorises the sale of alcohol and provision of regulated entertainment.

 

Members are invited to consider the information and documents referred to in Document “F” and determine if any interim steps are necessary, pending the full summary review hearing.

Representations

 

The Assistant Director, Waste, Fleet and Transport Services presented a report, Document “F” which outlined an application for a summary review of a premises licence for the sale of alcohol and provision of regulated entertainment which had been received from West Yorkshire Police. 

 

Members were advised that on receipt of a valid application for summary review the licensing authority must, within 48 hours, consider whether it was necessary to take any interim steps pending determination of the review of the premises licence.  The authority must then undertake a full review within 28 days of the receipt of the application.

 

It was explained that West Yorkshire Police had requested a summary review of the licence following a serious assault at the premises in the early hours of Saturday 25 November 2017.  The police were of the opinion that other procedures under the Licensing Act were insufficient in the circumstances due to the seriousness of the incident and the potential for further disorder at the premises as a result of the incident.

 

The representative of West Yorkshire Police addressed the Panel and reiterated that the request to review the licence had not been taken lightly but was due to the seriousness of the incident, subsequent public reaction and the potential impact on public safety.

 

During a summary of the incident it was reported that at 3.30am on Saturday 25 November 2017 police had been called by the ambulance service to an incident were a 24 year old man was unconscious and bleeding from the head.  The injured person was a young man, well known in the area, and he had, allegedly, been evicted from the premises.  The young man had, sadly, subsequently passed away.

 

It was explained that Police investigations were currently on going and, due to the serious nature of those investigations, further information could not be disclosed without prejudicing those investigations. As the premises had been associated with serious crime; following escalating tension and evidence about the potential for retribution it was believed that suspension of the licence was the only justifiable option.

 

Members were advised that the licence had been granted, by Members, on 14 June 2016.  There had been considerable community opposition at that time and subsequent incidents in the area, assumed to be related to the premises, had been received with public outcry.

 

The police representative explained that additional information he wished to report could prejudice future criminal investigations and it was
