DISCLOSURES OF INTEREST

(Members Code of Conduct - Part 4A of the Constitution)

 

To receive disclosures of interests from members and co-opted members on matters to be considered at the meeting. The disclosure must include the nature of the interest.

 

An interest must also be disclosed in the meeting when it becomes apparent to the member during the meeting.

 

Notes:

 

(1)       Members may remain in the meeting and take part fully in discussion and voting unless the interest is a disclosable pecuniary interest or an interest which the Member feels would call into question their compliance with the wider principles set out in the Code of Conduct.  Disclosable pecuniary interests relate to the Member concerned or their spouse/partner.

 

(2)       Members in arrears of Council Tax by more than two months must not vote in decisions on, or which might affect, budget calculations, and must disclose at the meeting that this restriction applies to them.  A failure to comply with these requirements is a criminal offence under section 106 of the Local Government Finance Act 1992. 

 

(3)       Members are also welcome to disclose interests which are not disclosable pecuniary interests but which they consider should be made in the interest of clarity.

 

(4)       Officers must disclose interests in accordance with Council Standing Order 44.

INSPECTION OF REPORTS AND BACKGROUND PAPERS

(Access to Information Procedure Rules – Part 3B of the Constitution)

 

Reports and background papers for agenda items may be inspected by contacting the person shown after each agenda item.  Certain reports and background papers may be restricted. 

 

Any request to remove the restriction on a report or background paper should be made to the relevant Strategic Director or Assistant Director whose name is shown on the front page of the report. 

 

If that request is refused, there is a right of appeal to this meeting.

APPLICATION FOR A REVIEW OF A PREMISES LICENCE FOR TREEHOUSE BAR AND KITCHEN, 3 FALLWOOD STREET, OFF OAK STREET, HAWORTH, BD22 8NP pdf icon PDF 174 KB

The Interim Assistant Director Waste, Fleet and Transport Services will

present a report (Document “K”) which outlines an application for a review of a Premises Licence authorising the sale of alcohol for consumption on and off the premises, the provision of regulated entertainment and the provision of late night refreshment at Treehouse Bar and Kitchen, 3 Fallwood Street, Off Oak Street, Haworth, BD22 8NW.

 

Members are invited to consider the information and documents

referred to in Document “K” and, after hearing interested parties,

determine the related application.

The Interim Assistant Director, Waste, Fleet and Transport Services presented a report (Document “K”) outlining an application for a review of a Premises Licence in respect of Treehouse Bar and Kitchen, off Oak Street, Haworth.

 

The Licensing Officer advised the Panel that the application for a review had been made by residents and Environmental Health on the grounds of prevention of public nuisance and the prevention of crime and disorder. 

 

Members were informed that residents had raised concerns in relation to noise and disturbance from patrons outside the premises, noise nuisance from entertainment held at the premises, anti-social behaviour, litter, smashed glasses, noise from the extraction system and parking issues. The representations were appended to (Document "K”).

 

The Environmental Health Officer was present at the meeting and informed the Panel that a number of complaints had been received by residents relating to excessive noise from the premises since July 2021. Members were also informed a letter of warning was serviced to the Premises Licence Holder. 

 

Subsequently, on 16th October 2021, Environmental Health Officers visited the premises between 22:40 hours and 24:00 hours, however found no serious licence breaches. Following further complaints from residents relating to excessive noise from patrons visiting the premises and noise from the extraction fan, the Environmental Health recommended that the opening hours of the premises be restricted from 10:00am to 23:00 hours on Friday and Saturday in order to address the public nuisance objectives.

 

Four residents were present at the meeting and had raised a number of concerns, including:

 

·         excessive noise from patrons visiting the premises and noise from outside seating area that would keep residents,

·         the extractor fan created continuous level of noise;

·         patrons would park on Oak Street which was a residential area, and there was an increase in traffic;

·         there was limited car parking spaces provided which caused issues with parking and deliveries on Oak Street and surrounding areas;

·         noise from cars and taxis slamming doors;

·         the car park was used for entertainment and loud music;

·         concerns related to litter, broken glasses and anti-social behaviour;

·         there was limited car parking spaces provided which caused issues with parking and deliveries on Oak Street and surrounding areas.

·         the impact of noise and disturbance, in particular during the night, had a serious effect on the residents’ amenity and wellbeing.

 

In response to the Panel question, the Environmental Health Officer informed that no concerns and been reported by the Police. However, residents had stated the issues had been reported to the Police but had been advised to contact the Council.

 

Whilst the residents acknowledged that some of the issues had been addressed by the Premises Licence Holder, however, significant problems remained, in particular during Friday to Sunday.

 

In response to a Member’s question, clarity was sought that the previous business had been transferred to the current License Holder and that the opening hours were unchanged.
