Notice of confirmation of an Order

 

Highways Act 1980 – Section 119

Public Footpath No. 44 (Silsden) (Part) at Banklands Lane, Silsden

 

On 23rd February 2023, the City of Bradford Metropolitan District Council confirmed the above Order made under section 119 of the Highways Act 1980.

 

The effect of the Order as confirmed is to divert the full width of part of Public Footpath No. 44 (Silsden) between Point A at Hawber Cote running south-easterly for 208 metres to Point B at Banklands Lane to Drabble House Farm then running in an east to west direction for 91.5 metres to Point C as shown on the Order map. 

 

An alternative Public Footpath shown as A-B by a bold broken line on 66666/T249/250/SIL44_Order Plan as follows:

 

A footpath 3.0 metres wide with an earth/grass surface with a 1.0 metre central strip of sand/ gravel commencing at Point A and running in a south-easterly for a distance of 220 metres to Point B as shown as shown on the Order map.

 

The new Public Footpath shown as C-D by a bold broken black line on 66666/T249/250/SIL44_Order Plan as follows:

 

A footpath 3.0 metres wide with an earth/grass surface with a 1.0 metre central strip of sand/ gravel commencing at Point C and running in a south-westerly for a distance of 146.5 metres to Point D as shown on the Order map.

The Order comes into force on 23rd March 2023, but if a person aggrieved by the Order wants to question its validity, or that of any provision contained in it,  on the ground that it is not within the powers of the Highways Act 1980 as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order,  he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within six weeks from 2nd March 2023 make an application to the High Court.
