DISCLOSURES OF INTEREST

(Members Code of Conduct - Part 4A of the Constitution)

 

To receive disclosures of interests from members and co-opted members on matters to be considered at the meeting. The disclosure must include the nature of the interest.

 

An interest must also be disclosed in the meeting when it becomes apparent to the member during the meeting.

 

Notes:

 

(1)       Members may remain in the meeting and take part fully in discussion and voting unless the interest is a disclosable pecuniary interest or an interest which the Member feels would call into question their compliance with the wider principles set out in the Code of Conduct.  Disclosable pecuniary interests relate to the Member concerned or their spouse/partner.

 

(2)       Members in arrears of Council Tax by more than two months must not vote in decisions on, or which might affect, budget calculations, and must disclose at the meeting that this restriction applies to them.  A failure to comply with these requirements is a criminal offence under section 106 of the Local Government Finance Act 1992. 

 

(3)       Members are also welcome to disclose interests which are not disclosable pecuniary interests but which they consider should be made in the interest of clarity.

 

(4)       Officers must disclose interests in accordance with Council Standing Order 44.

INSPECTION OF REPORTS AND BACKGROUND PAPERS

(Access to Information Procedure Rules – Part 3B of the Constitution)

 

Reports and background papers for agenda items may be inspected by contacting the person shown after each agenda item.  Certain reports and background papers may be restricted. 

 

Any request to remove the restriction on a report or background paper should be made to the relevant Strategic Director or Assistant Director whose name is shown on the front page of the report. 

 

If that request is refused, there is a right of appeal to this meeting.

The Strategic Director, Environment and Sport will present a report (Document “J”) that outlines an application for a new premises licence for the sale of alcohol for consumption off the premises.

 

Members are invited to consider the information and documents referred to in Document “J” and, after hearing individuals, bodies or businesses, determine the related application.

Representations:

 

The licensing officer in attendance summarised the background to the application and valid representations received as set out in the report.  Members were informed that the applicant held a licence at 53 North Parade and wanted to move to a larger premises, therefore, a new licence was required.  The proposed hours of licensable activity were Monday to Sunday from 0800 hours to midnight.  The licensing officer explained that West Yorkshire Police had submitted a representation and were then informed by HM Revenues and Customs that they had undertaken a visit to the applicant’s current premises, where illegal cigarettes, tobacco and alcohol had been confiscated.  It was noted that negotiations had then ensued with the applicant, his solicitor and the police in relation to this matter, which had culminated with a response from the police requesting that a number of conditions be placed on the licence.  The applicant’s representative had then agreed that all the proposed conditions would be implemented by the applicant.  The licensing officer then asked Members to consider whether further conditions would be required.

 

The applicant’s representative confirmed that the applicant currently occupied 53 North Parade but wanted to purchase the neighbouring premises, as he required a larger shop.  He indicated that he could not comment on the visit undertaken by HM Revenues and Customs because his client had sold the premises prior to this and had not been involved in the investigations.  Negotiations had taken place with the police and they were now satisfied with the application, subject to the compliance with the proposed conditions.  In conclusion the applicant’s representative stated that the applicant wished to open his new business as soon as possible before Christmas.

 

In response to queries the applicant’s representative informed Members that new jobs would be created and two of the new staff members would be personal licence holders.  The licensing officer clarified that the police had requested that one personal licence holder would need to be present at the premises at any given time.  The applicant’s representative then confirmed that the applicant would appoint two personal licence holders so that they could work a rolling shift pattern.

 

In summation the applicant’s solicitor stated that all the proposed conditions would be complied with and that consideration would be given to any additional suggestions by the Council.  He then requested that the licence be granted.

 

Decision –

 

That having considered all valid representations made by the parties to the hearing; valid written representations received during the statutory period; the published statement of licensing policy and relevant statutory guidance, the panel grants the application subject to the following conditions:

The Strategic Director, Environment and Sport will present Document “K” which outlines an application for variation to include the provision of late night refreshment, performance of dance, exhibition of films and indoor sporting events and replace the existing non standard timings with new non standard timings for live and recorded music and the sale by retail of alcohol.

 

Members are invited to consider the information and documents referred to in Document “K” and, after hearing individuals, bodies or businesses, determine the related application.
